These Terms and Conditions (“Terms”) govern the use of the website and the purchase of products from Mylky BV (“Mylky”, “we”, “us”, or “our”).

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.

2. Scope and Applicability

These Terms apply to all offers, orders, and agreements concluded via our website.

If you are acting as a consumer within the meaning of applicable EU consumer protection law, your mandatory statutory rights remain unaffected.

By placing an order, you confirm that:

• you are at least 18 years old or have legal parental consent
• you are legally capable of entering into binding contracts

3. Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, and prices are accurate.

However:

• minor variations in colour, packaging, or design may occur
• manifest errors or obvious mistakes are not binding

We reserve the right to modify or discontinue products at any time.

The products are designed and intended solely for normal domestic household use.

Customers must follow all safety, installation, and usage instructions provided with the product.

We shall not be liable for damages resulting from failure to follow instructions, improper installation, misuse, or use contrary to the intended purpose.

4. Formation of the Contract

A purchase agreement is only concluded once you receive an order confirmation or shipping confirmation email from us. The automated order confirmation does not constitute acceptance of the order.

We reserve the right to refuse or cancel an order in cases including but not limited to:

• product unavailability
• suspected fraud or unauthorized payment
• manifest pricing or technical errors

If payment has already been made, a full refund will be issued without undue delay.

5. Prices and Payment

All prices are shown in the applicable currency and include VAT where legally required, unless explicitly stated otherwise.

Delivery costs and any additional charges will be clearly indicated before checkout.

Payment must be completed at the time of ordering using the available payment methods.

Payments are processed through secure third-party payment providers. We do not store full payment card details.

Ownership of the products transfers to the customer only after full payment has been received.

6. Delivery

We deliver to the countries listed on our website.

Delivery times are estimates and not guaranteed.

If we fail to deliver the goods within 30 days, the consumer may request delivery within an additional reasonable period. If we still fail to deliver within that additional period, the consumer has the right to terminate the contract.

Risk of loss or damage passes to the consumer when the goods are physically delivered to the consumer or a third party designated by the consumer.

If the consumer independently appoints a carrier not offered by us, risk transfers at the moment the goods are handed over to that carrier.

We are not responsible for delays caused by circumstances beyond our reasonable control, including events affecting logistics partners or customs authorities.

The consumer is requested to inspect the goods upon delivery and notify us without undue delay of any visible damage or missing items.

7. Right of Withdrawal (EU Consumers)

Consumers residing in the European Union have the statutory right to withdraw from their purchase within 14 days without providing any reason.

The withdrawal period will expire 14 days after the day on which the consumer, or a third party designated by the consumer (other than the carrier), takes physical possession of the goods.

To exercise the right of withdrawal, the consumer must notify us of their decision by means of a clear and unambiguous statement sent to:

Effects of Withdrawal

Upon valid withdrawal:

• All payments received from the consumer will be refunded within 14 days from the date on which we are informed of the withdrawal decision
• We may withhold reimbursement until we have received the returned goods or the consumer has supplied sufficient evidence of having returned them, whichever occurs first
• Refunds will be made using the same payment method used for the original transaction, unless expressly agreed otherwise

The consumer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and basic functioning of the product.

8. Legal Guarantee and Commercial Warranty

Under EU law, consumers benefit from a minimum 2-year legal guarantee of conformity.

In addition, Mylky provides a commercial warranty of two (2) years from delivery covering manufacturing defects under normal use.

The warranty does not cover misuse or improper installation, accidental damage, normal wear and tear, or unauthorized repairs or modifications.

Warranty claims must be submitted via support@mylky.co including the order number, description of the defect, and supporting photos or video.

Where a valid claim is confirmed, we may offer repair, replacement, price reduction, or refund in accordance with applicable law.

9. Use of the Website

You agree not to use the website for unlawful or fraudulent purposes, attempt unauthorized access to systems, interfere with website functionality or security, or distribute malware or harmful technologies.

We reserve the right to restrict access in case of misuse.

We may temporarily suspend access for maintenance, updates, or security reasons.

10. Intellectual Property

All intellectual property rights on the website and products — including trademarks, designs, text, graphics, and software — remain the property of Mylky BV or its licensors.

No content may be copied, reproduced, distributed, or commercially used without prior written consent.

11. Limitation of Liability

Nothing in these Terms limits liability where such limitation is prohibited by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of mandatory consumer rights.

Subject to the above, Mylky shall not be liable for indirect or consequential losses, loss of profit or business, or losses resulting from improper use of products.

Our total liability shall in any case be limited to the purchase price of the product concerned.

12. Force Majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, strikes, supply chain disruptions, governmental actions, or transport failures.

13. Privacy and Cookies

Personal data is processed in accordance with our Privacy Policy and Cookie Policy.

14. Amendments

We may update these Terms from time to time.

The updated version will be published on our website with the revised date.

Material changes will not affect confirmed orders already placed.

15. Governing Law and Disputes

These Terms are governed by Belgian law.

Consumers may also rely on mandatory consumer protection provisions of their country of residence within the European Union.

Disputes shall be submitted to the competent courts of Belgium.
